1. Scope
The following terms and conditions (GTC) apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.
For entrepreneurs, the following applies: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they will only become part of the contract if we have expressly agreed to them.
2. Contractual partner, contract conclusion, correction options
The purchase contract is concluded with CS Bewässerungssysteme GmbH.
By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained during the ordering process. The contract is concluded when you accept the offer for the products in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive another confirmation via email.

We store the contract text and send you the order data and our terms and conditions in text form. The contract text is no longer accessible via the internet for security reasons.
4. Delivery conditions

Standard shipping is free of charge for orders with a value of 15 euros including VAT or more.

5. Payment
5.1 Prices
The prices indicated at the time of the order apply. These are total prices and include the statutory VAT.

The following payment methods are generally available in our shop.
Advance payment
If you choose advance payment, we will provide our bank details in a separate email and deliver the goods after receipt of payment.
Cash payment upon collection
You pay the invoice amount in cash when you pick up the order.
PayPal, PayPal Express
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your access data, and confirm the payment instruction. 6. Right of withdrawal
You have the statutory right of withdrawal as described in the withdrawal policy.
7. Retention of title
The goods remain our property until full payment has been made.
For entrepreneurs, the following applies in addition: We retain title to the goods until full settlement of all claims arising from an ongoing business relationship. You may resell the reserved goods in the ordinary course of business; any claims arising from such resale shall be assigned to us in advance in the amount of the invoice, regardless of any connection or mixing of the reserved goods with a new item, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations. We will release the securities due to us at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
8. Transport damages
For consumers, the following applies: If goods are delivered with obvious transport damages, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us assert our own claims against the carrier or transport insurance.
9.1 Liability for defects
Unless expressly agreed otherwise below, the statutory law on liability for defects shall apply.
The following limitations and shortened periods do not apply to claims resulting from damages caused by us, our legal representatives, or agents
- in the case of injury to life, body, or health
- in case of intentional or grossly negligent breach of duty as well as fraud
- in case of breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations)
- within the scope of a guarantee promise, if agreed, or
- if the scope of application of the Product Liability Act is opened.
Limitations for entrepreneurs
With regard to entrepreneurs, only our own information and the manufacturer's product descriptions that have been included in the contract shall be deemed an agreement on the quality of the goods; we accept no liability for public statements made by the manufacturer or other promotional statements. For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk.
The statutory limitation periods for the right of recourse according to § 445a BGB remain unaffected.
Provisions for merchants
Among merchants, the duty to inspect and give notice of defects regulated in § 377 HGB applies. If you fail to make the notification specified therein, the goods shall be deemed approved, unless the defect was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

10. Liability
We shall always be liable without limitation for claims due to damages caused by us, our legal representatives, or agents
- in the case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in the case of guarantee promises, if agreed, or
- if the scope of application of the Product Liability Act is opened.
In the event of the breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations) through slight negligence by us, our legal representatives, or agents, the liability shall be limited in amount to the foreseeable damage at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
11. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
12. Final Provisions
If you are an entrepreneur, German law applies under the exclusion of the UN Sales Law.
