Your Statutory Rights in Case of Defective Goods
If purchased goods are defective, consumers are entitled to the statutory rights in case of defects. These rights arise directly from the purchase contract and are not restricted by the following information.
Remedy
If goods are defective, you may initially request a remedy in accordance with the statutory requirements. As a general rule, you may choose between having the defect repaired and receiving replacement goods free from defects. The seller bears the expenses necessary for the remedy in accordance with the applicable statutory provisions.
Further Statutory Rights
If the respective statutory requirements are met, further rights may apply in addition to the remedy, including a reduction of the purchase price, withdrawal from the contract, damages or reimbursement of expenses incurred in reliance on proper performance.
Limitation Period for New Goods
For the new goods offered by us, the regular statutory limitation period for claims relating to defects is generally two years from delivery of the goods. Statutory provisions concerning the suspension, expiry suspension and recommencement of limitation periods remain unaffected.
Presumption During the First Year
If, in a consumer sale, a condition of the goods that does not comply with the statutory requirements becomes apparent within one year from the passing of risk, it is generally presumed that this condition already existed when the risk passed. Statutory exceptions remain unaffected.
The statutory legal guarantee must be distinguished from a voluntary commercial guarantee. CS Bewässerungssysteme GmbH currently does not provide any additional voluntary commercial guarantee. Your statutory rights in case of defects remain unaffected.
